NMS Giyim ve Mağazacılık Ticaret Anonim Şirketi ("NMS" or "Company"); In accordance with the Personal Data Protection Law No. 6698 ("PDPL"), as a data controller, it has adopted a number of basic rules to protect the confidentiality of personal data. Pursuant to Article 10 of the PDPL, this clarification text has been prepared to inform you about the purpose, scope, periods and other issues that may affect you regarding the processing of the personal data you share.

• Method and Legal Purpose for Collection of Personal Data

The personal data you have shared within the scope of the services provided by NMS as a service provider; It may be processed by NMS for reasons directly related to the fulfillment of legal obligations, for reasons directly related to the establishment and performance of the contract, for reasons stipulated by law and for the legitimate interest of the Company. In this scope, personal data may be collected by NMS; at the time of the establishment of the membership relationship or in the following period, within your consent, verbally, in writing or electronically to NMS and by creating a user record and recording information or making a request or complaint. 
NMS fulfills obligations to take all necessary technical and administrative measures to prevent unlawful processing of personal data, to prevent unlawful access to data, and to ensure the appropriate level of security to ensure the protection of personal data.

• Processing and Purposes of Personal Data 

Your personal data may be processed by NMS for the following purposes in accordance with the basic principles stipulated by the PDPL and within the personal data processing conditions and purposes specified in Articles 5 and 6 of the PDPL:

     • Creating a Member account during the product purchase phase via www.babyfee.co ("Website") and/or on the Website;

     • Fulfillment of the requirements of the sales contract established between you and NMS;

     • Utilization of services offered by the NMS;

     • Establishing sustainable and long-term interactions in customer relations and conducting after-sales support processes;

     • Follow-up of requests and complaints and resolution of disputes and problems that may arise in the future,

The following personal data of the data subjects may be processed by NMS.

• To Whom and For What Purpose The Processed Personal Data Can Be Transferred

The collected personal data may be transferred to our business partners, shareholders, third party service providers, legally authorized public institutions and private persons in accordance with the basic principles stipulated by the PDPL and within the personal data processing conditions and purposes specified in Articles 8 and 9 of the PDPL, in line with the personal data processing purposes determined by NMS; to fulfill legal obligations, for reasons directly related to the establishment and execution of the contract for reasons provided by law and for the legitimate interest of NMS.

Retention Period of Personal Data

The Company shall retain personal data for the period stipulated in the relevant laws and regulations.
If the purpose of processing personal data has expired and the relevant legislation and the specified retention periods have expired; personal data may be stored only for the purpose of constituting evidence in possible legal disputes or to assert the relevant right related to personal data or to exercise the right of defense. In this case, the stored personal data is not accessed for any other purpose and access to the relevant personal data is provided only when it is required to be used in the relevant legal dispute. After the aforementioned period expires, personal data are deleted, destroyed or anonymized. 

• Erasure and Destruction of Personal Data

Your personal data stored within the scope of the Law on the Protection of Personal Data will be kept until the end of the maximum period specified in the relevant legislation or required for the purpose for which they are processed and in any case until the legal expiration of the for statute of limitations. Although processed in accordance with the provisions of the relevant law as regulated in Article 138 of the Turkish Criminal Law and Article 7 of the PDPL, in the event that the reasons requiring processing disappear, personal data will be deleted, destroyed or anonymized under the conditions determined by the Regulation on Deletion, Destruction or Anonymization of Personal Data published in the Official Gazette dated 28.10.2017 and numbered 30224 or upon your request.

• Your Rights

As personal data subjects, if you submit your requests regarding your rights to our Company, the Company will conclude free of charge as soon as possible and within thirty (30) days at the latest, depending on the nature of the request. In this scope:
        •  To learn whether personal data is being processed,
        •  Request information if their personal data has been processed,
        •  To learn the purpose of processing personal data and whether they are used for their intended purpose,
        •  To know the third parties to whom personal data are transferred domestically or abroad,
        •  To request correction of personal data in case of incomplete or incorrect processing and to request notification of the transaction made within this scope to third parties to whom personal data is transferred,
        •  Although it has been processed in accordance with the provisions of the Law and other relevant laws, to request the deletion or destruction of personal data in the event that the reasons requiring its processing disappear and to request notification of the transaction made within this scope to third parties to whom personal data is transferred, 
        •  To object to the emergence of a result to the detriment of the person himself/herself by analyzing the processed data exclusively through automated systems,        
        • In case of damage due to unlawful processing of personal data, it has the right to demand compensation for the damage.
